This Agreement is legally binding and made by and between Taru Villas (Pvt) Ltd (the “Taru Villas”, “our”, “us”, “we”) and each individual, business, organization or other person or entity (“you”, “your”, “user/s”) that uses and or accesses the Taru Villas.
By accessing or using the Site, you agree to be bound to the Terms and Conditions described in this Agreement. If you do not agree to these Terms, do not access, or use the Site and the Services offered by us. Each time our Site is used, an implicit affirmation is given for the acceptance of the Terms herein.
Any use of the Site, or written communication with Trau Villas, for the purposes of travel arrangements, confirms that you are aged 18 or over and that you have read and fully accept these Terms.
We may modify these Terms, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your use of the Site after such posting shall be deemed to constitute acceptance by you of such modifications, additions or deletions. Taru Villas may modify, suspend, discontinue or restrict the use of any portion of the Site, including the availability of any portion of the content at any time, without notice or liability.
Subject to your compliance with the Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site solely in connection with your permitted use of the Site.
In addition to the foregoing restrictions, you further agree that in connection with your use of the Site, you will not in any manner use any devices or mechanisms, to disrupt, alter or destroy, the proper operation of the Site, or download or copy the Site or the content therein.
You may use this Site in accordance with these Terms complying with all applicable laws, regulations and codes of practice in Sri Lanka and/or other jurisdictions from which you are accessing the Site. Where Taru Villas believes in its absolute discretion that you are in breach of any of these Terms, without prejudice to any of our rights at law or otherwise, we reserve the right to deny you access to this Site.
All recommendations, opinions expressed and prices regarding properties and/or destinations displayed are provided for guidance only. You agree as the user that the use of, or reliance upon, any of the content of the Site, and in particular any content recommending any hotel, product or service, is done entirely at your risk (including content in subsequent itinerary documents sent to you).
Our Site may contain links to websites operated by 3rd parties. Those links are provided to you for your reference and convenience only. We do not own or control the contents of those websites and are not responsible for their content or your use of them. We cannot be held liable for any discrepancies or differences that might arise between the Content of our Site (text, images etc), and any other 3rd party websites.
We have endeavored to portray and describe each hotel and/or service as best we can and also to provide the most up to date information through our Site and other communications with you to the best of our knowledge.
Although we attempt to keep all information in our Site accurate and up to date as far as it is reasonably possible, the accuracy and timeliness of the information provided cannot be guaranteed. We hope that you will find the information helpful and easy to use, but we provide all content for informational purposes only and make no representations or warranties of any kind regarding the same.
Trau Villas, its management, its officers, directors and employees, disclaim all liability of any kind whatsoever arising out of the use of, or inability to use, the Site and the information contained on them. Whether such liability is under contract, tort or otherwise, Taru Villas, its management including its officers, directors and employees cannot be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Site. The Site was designed to provide information about Taru Villas and its products and services. Use of this system for any purpose other than that for which it was designed is unauthorised and prohibited.
All parties submitting materials to the Site, by submission grant Taru Villas a non-exclusive, worldwide, irrevocable, sublicensable licence to use, install, reproduce, copy, adapt, publish, translate and distribute it in any media in connection with our servers. Further, you represent and warrant that the submission, installation, reproduction, copying, adaptation, publication, translation, distribution and use of such materials in connection with our Site shall not violate any other party’s proprietary or legal rights. The Management reserves the right to remove any submissions made, on this Site at any time, and for any reason, without prior notice.
The material and content provided on the Site are strictly for your personal and non-commercial use only. Except as otherwise indicated, all materials on this Site, including, but not limited to text, hotel information, tour information, customer or partner references, data, images and pictures, illustrations and written and other materials contained in this Site are protected by copyrights, database rights, trademarks and / or other Intellectual Property rights owned, or used with permission of their owners by us or our partners, affiliates or associates. This Site as a whole is protected by copyright and other intellectual property rights and as such, all rights are reserved.

If any of the booking conditions are invalid or unenforceable then subject to law, all other provisions of the booking conditions shall be and continue to be valid and enforceable.
You hereby indemnify to the fullest extent the Management of Trau Villas, including its officers, owners, directors, employees, affiliates, agents, licensors, representatives, attorneys, and business partners from and against any liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of your use of the Site, or use of the Site by any person using your Site account or in any way related to your breach of any of the provisions of these Terms.
We would wish to resolve amicably any reasonable complaint that we receive relating to the standard of service or accommodation arrangements.
If your complaint cannot be resolved locally you must follow this up by writing a formal complaint letter to us within 28 days of your return home incorporating all other relevant information. It is a condition of these Terms that you communicate any problem relating to the standard of service or accommodation arrangements to the relevant authority at the Taru Villas property you will be staying in. If still not resolved, then follow this up with a written complaint. If you fail to follow this simple procedure, we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the matter.

These Terms and Conditions shall be subject to Sri Lankan law and the exclusive jurisdiction of the Sri Lankan Courts.
In the event there are any discrepancies in the translations of the website, the English version will prevail.
